RE: Presidential Executive Order Limiting Refugees into the United States
This afternoon, CBP provided additional guidance regarding the Executive Order that was issued on 27JAN2017.
Countries Impacted
Suspension of issuance of Visas and other Immigration Benefits for 90 days to Nationals of the following countries:
- Iran
- Iraq
- Libya
- Somalia
- Sudan
- Syria
- Yemen
Entry to Nationals of these Countries is suspended effective 27JAN2017 for 90 days. Non-immigrant, Immigrant Resident Aliens, Refugees and Assylees are all subject to this Order. This means that a National of one of the Countries listed above, who lives in the United States is subject to the terms of this Order upon return from an overseas trip. The Order also applies to previously issued Visas, which the State Department is now working to revoke. The only exception to the Order are the holders of the following Visa types:
- Diplomatic
- C2
- NATO
- G1, G2, G3, G4
Naturalized citizens of the United States are not covered under this Order.
Local Impact
CBP, along with the State Department, is working closely with overseas Embassies to prevent individuals covered under this Order from boarding flights at the point of origin. In cases where the individuals are permitted to board, they will be processed in the Admissibility Review Unit (ARU). Individuals will be placed into expedited removal from the United States if they opt to withdraw their application for entry into the Untied States. Individuals who either do not withdraw their entry applications or do not have the monetary means to return to their Country of origin will only be released when a return ticket is confirmed.
Does this only apply to Nationals or Passport holders?
At this time all Nationals of the seven listed Countries will be processed in the ARU. Lawful, permanent residents are included in this Order. CBP is awaiting additional guidance from Washington.
Are Flight Crews Exempt?
No. Flight crew members who are Nationals of these countries are subject to the Order.
Do visits to one of these Countries Apply?
Visits are not covered under this particular Order, but remain subject to previous inspection protocol.
Does this Order apply to Dual-Citizens?
CBP is awaiting additional guidance.
Is CBP issuing fines to Airlines?
As of today, no. This may change in the days to come and will be communicated at that time.
